General Terms and Conditions (GTC) for the PLAS Holiday Apartment
§ 1 Scope
* These General Terms and Conditions (GTC) apply to contracts for the rental of the holiday apartment at Jadranska cesta 102, 23210, Turanj, Croatia for accommodation, as well as all other services and deliveries provided by the landlord for the guest.
* These GTC are an integral part of every rental agreement. Deviating or supplementary agreements require the express written consent of the landlord.
§ 2 Conclusion of Contract
* The accommodation contract is concluded when the landlord confirms the guest's booking request in writing (by email or mail), thereby declaring acceptance of the offer.
* The booking party is jointly and severally liable for all obligations arising from the contract for all persons listed in the booking.
§ 3 Prices and Payment
* The agreed prices include the applicable statutory VAT.
* The total rental price is due immediately.
§ 4 Deposit
* The deposit serves as security for all claims of the landlord arising from the rental agreement, in particular for damage to the inventory or excessive contamination.
* The deposit will be refunded to the account specified by the guest within 14 days after the proper return of the holiday apartment, its inventory, and the keys, less any claims by the landlord.
§ 5 Cancellation and Withdrawal by the Guest
* The guest may withdraw from the contract in writing at any time before the start of the rental period. The receipt of the notice of withdrawal by the landlord is decisive.
* If the guest withdraws from the contract or does not use the service, the landlord may demand appropriate compensation. The flat-rate cancellation fees are generally:
* up to 60 days before the start of the rental period: 20% of the total rental price
* from the 29th to the 7th day before the start of the rental period: 80% of the total rental price
* from the 6th day before the start of the rental period and in case of no-show: 90% of the total rental price
* Travel cancellation insurance is strongly recommended.
* The landlord is obligated to rent the canceled apartment to someone else if possible to minimize loss.
§ 6 Arrival and Departure
* The apartment is available to the guest from 3:00 PM on the day of arrival.
* Departure must be by 10:00 AM on the agreed departure date at the latest. The landlord may charge an additional fee for late vacating the apartment.
§ 7 Guest Obligations
* The guest undertakes to treat the holiday apartment and its inventory with care.
* The holiday apartment may only be occupied by the number of people stated in the rental agreement. Overcrowding entitles the landlord to terminate the contract without notice.
* Smoking is not permitted anywhere in the holiday apartment. Violations may result in a cleaning fee of €100.
* Pets are not allowed.
* The guest is obligated to comply with the house rules, which are an integral part of these Terms and Conditions.
* The guest must immediately notify the landlord of any damage to the holiday apartment or its inventory.
§ 8 Liability
* The guest is liable for all damage that they, their fellow travelers, or their visitors culpably cause in the holiday apartment.
* The landlord is liable for items brought into the apartment by the guest in accordance with the statutory provisions, insofar as these are deemed to have been brought in within the meaning of §§ 701 et seq. of the German Civil Code (BGB). Further liability is excluded.
* * The landlord's liability for other damages is limited to intent and gross negligence.
§ 9 Internet Use (Wi-Fi)
* The guest receives free internet access via Wi-Fi during their stay.
* The guest agrees not to use the internet connection for illegal activities (in particular, illegal downloads or copyright infringements).
* The guest indemnifies the landlord against all claims from third parties based on the guest's illegal use of the internet.
§ 10 Final Provisions
* Amendments or additions to the contract, the acceptance of the application, or these General Terms and Conditions must be made in writing.
* Should individual provisions of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
* The place of jurisdiction is the landlord's registered office, provided the guest is a merchant within the meaning of the German Commercial Code (HGB). The law of the Federal Republic of Germany applies.
